COMMISSION TOS

General:1) I can refuse to work with someone if I feel uncomfortable with them in terms of being part of my DNI list. I will not hesitate to block you if you are someone who makes public posts of artists for this; all I want is to prioritize my safety and comfort when working with certain individuals.2) All WIP progress of commissions sent for proof will be heavily watermarked to prevent stolen works.3) The client is free to give references and specific details of their commissioned request to the artist, but I will never accept any AI generated images for referencing; the client will be blacklisted if I'm forced to use it.4) Finished artworks will be sent in high quality to the client within email or the platform itself like DISCORD or VGEN.5) Blacklisted users and known scammers may not commission me for my services, and will be called out if they're trying to bypass with a different user/account — or had applied the same behaviors to other several artists continuously.6) Users buying my commissions should be at least 15+ or have a parental guardian in their place if you are not legal to own a payment processor like paypal or a certain bank. I have the rights to refund the money back to the user if they are authorizing a transaction under that age — as well as being responsible of a certain content that the user had asked for the commissioned like sensitive topics/themes to be properly dealt with.6) Due to paypal becoming a bitch — I'll have to ask for the client not to give any note when sending out payment for their commissions and labelling it with the words 'commission', 'tip/donation', or 'NSFW' (for more context, look into this post)-----------Contract & Agreement:1) The artist has the rights to decline a commission if it does not meet the criteria, or if the artist is uncomfortable of the inquiry that the client had requested. Be it either2) Between artist and client; You, as the client, should adhere that you are responsible for the fees and guidance of your commissioned request during the communication with the artist — any complaint for your own misguidance is not an excuse to berate the artist for working with you.3) Any communication between as an artist & client should also know the fine line between the transactional contract of both sides — I, as the artist, is not obligated to make conversations that doesn't apply with the commission. Emotional topics like venting and topics that I am not obligated to be part of should not be discussed, and neither should I; our contact should remain professional and transactional — both sides are not entitled to drop irrelevant topics to one another.4) I cannot accept bargains to lowball my prices just to be adjusted for the user buying my services. You are responsible of your budget — undermining the value of an artist is very disrespectful, and I will not tolerate to accept it.5) I have the rights to use the commissioned work to be displayed as a sample of my portfolios for future. You can simply ask that you don't want that, and want to have the piece be private instead. This is all free, you just need to ask.-----------Payment & Fees:1) I allow both half & full payment as available options. The client can either pay 50% of the price after sketch or full payment before the final artwork is sent the last minute afterwards. This prevents scamming for both parties — as this can be discussed privately if you are willing to pay in whichever option.2) Refunds can only be viable if the client has a valid reason to cancel the commission — otherwise, I cannot allow refunds for such things like not being able to pay before/after I have updated several times on asking the client to pay immediately for the work.3) Revisions are only free during sketch phase of the work. Once it had passed from that phase — any more revisions are charged depending on the commission or details of it.4) All commissioned art with applied fees like extra characters and revision fees must be simply be met accordingly.-----------Work time:As the artist, I take full responsibility for the TAT when working with the client's commission; If the artist has not updated in a while, don't be afraid to ask for an update and I will try to honestly give the status and diligently work on the artwork. Art takes time, and I value my work with it. If the client demands for a rushed TAT on a specific date, they should at least include that deadline before the contract had started — any form of pressure or harassment will not be tolerated, and I can cancel the commission and refund the client if I feel uncomfortable to keep working with the client.-----------Discounts:Returning clients get 25% off when spending more than one artworks that may cost around $50 or more; this will not apply if the client is charged or has commissioned anything lower than the set amount.-----------Usage of Artwork:1) All commissioned artworks are completely personal use by default. You can use it as a pfp, share to friends, showcase it, etc. — the only thing I ask is not to use it for commercial use if the client has not paid for extra fees regarding it; Any use of the artwork for things such as promotional banners for a patreon, commercial merchandise, and the likes are NOT allowed.2) I still hold the rights to the commissioned artwork. If sharing at your own platforms for the public to see — you must credit me as the artist. If you cannot do that and try to claim it as your own by erasing my signatures/watermark, then you will end up on my blacklist.3) Scraping my works to train genAI & relations NFT are strictly prohibited — as I do not allow such things to happen with my works to be fed in these unethical assets.

DESIGN TOS

General:
1) All official adoptables are all given a credit tracing back to my account! My adopt tag 'sushibun design' can be removed if the current owner wants to; The only thing that I ask is to not have my design credit be removed if the design is sold within TOYHOUSE, UNVALE, or VGEN. I often check ownership to whoever currently owns my designs from time to time just to see if the person is a blacklisted user or the user is aware of my design TOS — if ever the current owner decides to private or hide the character, they should be willing to notify me with an explanation on my behalf or have a choice to authorize me. Any form of aggression will be resulted into a blacklist (This strict rule does not apply to anyone hoarding/collecting my designs just for enjoyment — I usually encourage people to do so if it's not something problematic)2) Never resell my designs for real currency with a higher cost from what you have bought it for — Only exception is when the character has multiple art pieces, animations, fursuit, etc. — On the other hand, any of my designs bought through non-profit trades like art3) Blacklisted users cannot, and are banned from having my designs! This also applies to certain users who have been called out and aren't from my knowledge being on my personal blacklist. Any current owner of my designs should know who they are reselling to and who they are interacting with, or else the people involved will be prone to being blacklisted and never have my designs ever again (I give chances to who weren't aware and explain their side of things)4) All of my designs are automatically commercial use. You can use them for promotional work like webcomics, ych examples, and physical merch with credit — However, any usage of my art for that character for such things are strictly prohibited5) I will not condone anyone who are from my DNI lists to own any design of mine. If found out, I have the rights to confiscate the character back and give it to a different user or ask the reseller to take it back from them (I will gladly confiscate them a change if the character was exchanged for money) This also applies to scammers and blacklisted users.6) Heavily inspirations from my designs — especially the ones that are still on sale or haven't been claimed yet — are not allowed and will get you blacklisted.7) If the adopt is set to bidding — a bidder must not delete commented bids if not in the budget, I accept payment plans per week, never get aggressive if another has obtained an AB, steal the designs and owning as your own; TOS rules above still apply.8) If you see any of my designs stolen by other users to others without my knowledge, pls reach out to me about the theft and the scammers.____________Usage:
You can use my designs for everything an owner desires — I only ask to not use it with such content like involving paraphilic shipping/writing, political beliefs that harms certain minority groups, bigoted behaviors of owner, and so on. I will not hesitate to confiscate the design back to me or the reseller if the owner who uses my designs for those specific purpose refuses to agree.I'd also have to make a callout post if your behavior as that kind of user if you engage in further offensive behavior against me and my privacy/boundary. This is not limited to harassment, defamation, spreading false rumors, engaging further on actions to belittle & trigger me or any other party connected to me etc.If you are not aiming for such content, and only using those certain topics to build the character and narrative with a respectful tone like educating regarding problematic themes mentioned as something bad and not romanticized in a good light — Then you may be permitted to ask me first until approval (If I refuse, then you need to drop it)____________Ownership:
Any user who obtain and own any character design of mine should adhere to my general TOS. As new owners from original buyer to the next will have to stick to my TOS forever if they have any of my designs in their storage.Owners should at least own my designs around 5 months max before reselling for real currency — this however, does not apply for traded characters who were exchanged with digital trades like art or characters. You can still trade off the character for art or characters etc. if the months of ownership has not reached the requirement to resell for real currency.If you do not follow this rule, You can no longer obtain anymore designs from my end unless you ask to explain at your end of the reason. I may or may not agree to lend you back that chance.If the adopt has a pre-existing old design or anything like description or lore, the current owner can archive/delete them without permission.____________Redesigns:
Any form of redesigning is approved, just as long it's still recognizable by color palette and certain aspects of it haven't had any major changes. Changing everything to the point it's not recognizable is not allowed!If an owner has made a redesign of my adopts into a different species and voids the original form or sells it, They will have to be reminded that I do not allow that sort of thing. I want my designs to be at least be respected from how it was before without any repercussion. Examples where the owner makes a pony, feral, or human version of the character, then sells the og form for profit is not allowed.____________Vouchers:
As per my new gathered knowledge around vouchers for adoptables, I will also apply this to my designs. Simple conditions only requires PERSON A (current owner selling) is to ask the OG DESIGNER (me) for a voucher on a specific character and wait for permission/confirmation. When PERSON A wants something from PERSON B (other party) like a gift card, in-game item, or other items outside the usual digital trades involving art or characters — then you have the approval.This only applies for exchanges between two parties who do not have the same payment processor (eg: PERSON A is paypal user, while PERSON B is cashapp/gcash user etc.) or PERSON B does not enough money to buy full price of the adopt, but has a desired item that PERSON A wants.

Extra characters are applicable if the the commission includes 3-12+ characters in one canvas, prices will be stacked by x2 or more if the characters are in a seperate canvases.ex: Client asks for full-shaded icon pieces of 3 characters in different canvases
